What Rights Do Families of Deceased Motorcyclists Have?
When a motorcyclist dies in an accident, even if it wasn’t intentional, California law allows close family members to file a wrongful death lawsuit if the crash involved driver negligence or dangerous road conditions.
📜 Laws That Support the Victims:
Law | How It Protects You |
California Code of Civil Procedure § 377.60 | Allows spouses, children, parents, and financial dependents to file a wrongful death claim when a negligent act causes the death of a loved one. |
California Vehicle Code § 21801(a) | Requires drivers turning left to yield the right-of-way to any oncoming vehicle that poses a hazard. If the Honda failed to yield to the motorcyclist, it may constitute negligence. |
California Vehicle Code § 21755 | Regulates passing on the right or oncoming lane. If the biker’s maneuver was lawful but poorly anticipated by the other driver, the latter may still bear liability. |
California Civil Code § 1714(a) | States that everyone is responsible for their own actions or omissions that cause harm due to lack of caution. This is a key foundation for civil liability claims. |
