Legal Rights for Families After a Fatal Motorcycle Crash
Under California Code of Civil Procedure §377.60, families who lose a loved one in a motorcycle collision may file a wrongful death claim to seek compensation for:
- Funeral and burial expenses
- Loss of financial support
- Loss of companionship and emotional suffering
- Damages tied to driver negligence
If an unsafe maneuver, failure to yield, or distracted driving contributed to the crash, the responsible driver may be liable under Civil Code §1714 (Duty of Care).
California’s comparative negligence rule also allows families to recover compensation even when multiple factors played a role in the collision.
