Legal Rights for Families After a Fatal Motorcycle Crash
When a rider is killed in a collision, surviving family members may file a wrongful death claim under California Code of Civil Procedure §377.60. Compensation may include:
- Funeral and burial expenses
- Loss of financial support and household services
- Emotional distress and loss of companionship
If the crash involved negligence, such as unsafe driving, distracted driving, or failure to yield, the at-fault driver may be liable under Civil Code §1714 (Duty of Care).
California’s comparative negligence law allows families to pursue damages even when multiple factors contributed to the crash.
