Fatal motorcycle crash on Highway 162 near Oroville

OROVILLE, CA — The California Highway Patrol (CHP) is investigating a fatal motorcycle crash that left one rider dead and another critically injured on Tuesday morning on Highway 162 near Mistletoe Lane in Butte County.

According to CHP’s Oroville office, the collision occurred around 10:44 a.m. when two motorcyclists traveling eastbound at a high rate of speed lost control and veered off the roadway onto a gravel shoulder.

Both riders struck a dirt embankment and were ejected from their motorcycles. Despite wearing helmets, the impact caused catastrophic injuries.

Emergency crews, including the Butte County Sheriff’s Office, CAL FIRE, and paramedics, responded quickly and provided life-saving aid.

One rider was transported to a local hospital, where he later died from his injuries, while the second was airlifted to Enloe Health in critical but stable condition, authorities said.

The identities of the riders have not yet been released pending family notification. CHP believes excessive speed was a major factor in the crash.

Motorcycle Safety on Rural Highways

Highway 162 is a popular route among riders in Butte County—but it also presents sharp curves, changing road textures, and limited shoulders that can increase crash risks.

According to the California Office of Traffic Safety (OTS):

  • Butte County recorded 108 motorcycle-involved fatalities or serious injuries in 2022.
  • Speeding and roadway departures are leading contributors to fatal rural motorcycle crashes statewide.
  • Even experienced riders face heightened danger on narrow or gravel-shouldered highways like 162.

Authorities urge motorcyclists to slow down, avoid sudden maneuvers, and maintain safe following distances, especially on winding or rural roads.

Legal Rights for Families and Injured Riders

Under California Civil Code §1714 (Duty of Care), any act of negligence or recklessness that causes harm on the road can create liability.

Families who lose a loved one in a motorcycle crash may file a wrongful death claim under Code of Civil Procedure §377.60 to seek compensation for:

  • Funeral and burial expenses
  • Loss of financial support
  • Emotional suffering and companionship loss

Survivors with severe injuries may also file a personal injury claim to recover damages for:

  • Medical costs and long-term rehabilitation
  • Lost wages and diminished earning capacity
  • Pain and suffering

California’s comparative negligence rule allows recovery even if multiple factors contributed to the crash.
